We need to revise the American loss system and lead the way in developing an equitable alternative in subrogation recovery rights the current system negates making allowances for attorney's fees paid by the victim and assigns a dollar value to the victim's health that is never sufficient to give the victim full compensation and often times insurance companies are permitted to be reimbursed from portions of the third party lawsuits allocable to pain and suffering for which it had not previously compensated the victim these are all reasons why the curent allowances for subrogation necessitates a through revision.
