Apple are forcing millions of Snow leopard users to upgrade to Lion at a cost of $30 as they will be shutting down MobileMe in June 2012 and all users are forced to use iCloud which does not support Snow leopard or older operating systems.  Ironically it does support Windows Vista as well as windows 7.

We the Employees of the Ministry of Community Safety and Correctional Service grieve that the following agreed terms between the union (O.P.S.E.U.) and the Ministry are not being followed as per the mutually agreed upon terms as outlined in the Collective Agreement. To wit the terms specified are as follows:

TERMS OF REFERENCE
FOR THE
MINISTRY FILE REVIEW COMMITTEE
The parties agree to a pilot project of six (6) Ministry File Review Committees or such greater number as
agreed upon by the parties.
NAME OF COMMITTEE:
The Committee shall be referred to as the Ministry File Review Committee (MFRC).
TERM/TERMINATION:
The Committee shall be in place for the term of the collective agreement. During this trial period either
party may terminate the Committee upon 30 (thirty) days written notice to the other party.
A review of the Committee’s progress shall be presented to the MERC every six (6) months.
Each MFRC shall provide an annual review to CERC.
EVALUATION:
METRICS
The parties agree that the pilot will be evaluated on the basis of the following criteria:
• Increased early and local resolution of grievances
• Fewer mediations and hearing dates required at the GSB
• Greater clarity of issues proceeding to the GSB
MEASURES
The parties agree to use the following measures to track the success of the pilot:
• Percentage of grievances referred to the MFRC
• Percentage of grievances resolved by the MFRC
• Percentage of grievances referred back to the Local
• Percentage resolved by the Local
• Percentage unresolved by the Local
• Percentage of grievances referred from the MFRC to GSB
• Percentage resolved prior to hearing date
PURPOSE OF COMMITTEE:
The governing principle will be that the parties have a mutual interest in their own solutions and avoiding, if at all possible, having the decision made by an arbitrator.
The Union and the Employer agree that consultation and communication on matters of joint interest are desirable to promote constructive and harmonious labour relations. In this regard, a Ministry File Review Committee (MFRC) shall be established to deal with grievances in an effective and expeditious manner at the Ministry level.
 The purpose of the Committee is to establish and maintain:
A procedure for the prompt and equitable handling of grievances, with the exception of Appendix 9,
Appendix 18, classification, insured benefits, grievances related to sexual harassment and union grievances
under Article 22.13.2.
• A review of grievances, to recommend consolidation/grouping issues, disclosure issues, adjournment, etc., and the manner in which unresolved grievances proceeding to GSB should be addressed;
• A common Ministry list of grievances;
• To review outstanding grievances through the use of this sub-committee.
WITHOUT PREJUDICE AND WITHOUT PRECEDENT:
It is agreed that the discussions of the parties at the MFRC are without precedent or prejudice. Any MFRC discussions shall receive the same level of protection as any stage of the grievance process and such discussions shall not be admissible before any Board, Tribunal, Commission, etc.
COMMITTEE MEMBERS AND MEETINGS:
• The MFRC shall be composed of three (3) Union representatives including an OPSEU staff member and three (3) Management representatives including a representative from Employee Relations Division who will be identified by their respective MERC Co-chairs. Members of the committee who are the grievor or respondent on a particular grievance shall excuse themselves from participating in the review of that particular file.
• The MERC Union Co-Chair shall designate one member to act as Union Co-Chair of the MFRC.
The MERC Management Co-Chair shall designate one member to act as the Management Co-Chair of the MFRC
• The parties may invite other resources as deemed necessary.
• MFRC participants are entitled to time off to attend MFRC meetings with no loss of pay and no loss of credits. Reasonable travel time will be provided.
• The Union MFRC members shall receive four (4) hours of paid caucus or prep time, excluding time needed for housekeeping, or as such further time as the parties agree.
• The MFRC shall meet monthly, unless the MFRC Co-Chairs agree otherwise. Meetings will take place at a mutually convenient and accessible location and time as agreed upon by the MFRC Co-Chairs.
• In accordance with Article 22.14.5 of the Collective Agreement, full disclosure of all the facts, issues and relevant documents shall take place to facilitate the effective resolution of the grievances submitted to the MFRC.
• Each MFRC participant shall maintain the confidentiality of any discussions between the parties and any information shared, except as agreed to by the parties, or as required by law, or as required to implement a settlement/agreement.
• Individual grievors and local managers will not attend MFRC meetings, unless both MFRC Co-Chairs agree otherwise.
 ARTICLE 22 PROVISIONS – Grievance Procedure:
During this pilot project, the provisions of Article 22 (Grievance Procedure) will apply. In accordance with Article 22.14.3, the parties agree to the following additional procedures for the purposes of the pilot project:
1) If the grievor is not satisfied with the Stage 2 decision of the senior human resources representative, or his or her designee, or if he or she does not receive the decision within the specified time, the Union may submit the grievance to the MFRC within fifteen (15) days of the date the grievor received the decision or within 15 (fifteen) days of the specified time limit for receiving the decision.
2) Upon receipt of an MFRC referral, the Union Co-Chair shall contact the Management Co-Chair at the earliest convenience. The MFRC will have a period up to 45 (forty-five) calendar days from the date the grievance is filed with the Committee, to attempt to resolve the grievance. If the Committee is unable to resolve the grievance, the Committee shall discuss how the grievance shall proceed.
3) During the 45 (forty-five) calendar day resolution period, the MFRC will attempt to resolve the matters in dispute, which shall involve the individuals with authority to resolve the grievance.
4) By agreement of the MFRC Co-Chairs, the MFRC may refer a grievance back to the local level for resolution. In this case, the parties agree that a local rep and ministry/management rep may assist in the resolution of the grievance within 14 (fourteen) calendar days from the date of referral. If the issue remains unresolved, the matter shall be referred back to the MFRC. For clarity, any time the grievance is spent at the local level will create a hiatus in the 45 (forty-five) calendar day period the MFRC will have to attempt to resolve the grievance.
5) If the MFRC is unable to resolve a grievance, it shall be referred to the Grievance Settlement Board (GSB) for mediation/arbitration or arbitration.
6) The MFRC Co-Chairs agree that the time limits are extended per Article 22.14.3 for all grievances referred to MFRC. At any time either party may remove a grievance from MFRC, in these cases, or in the event that the MFRC can not resolve the grievance within the prescribed timelines, the Union shall have 15 (fifteen) days to file the grievance to the GSB per Article 22.4 of the Collective Agreement.
This agreement is not arbitrable.

Furthermore we the Employees of the Ministry of Community Safety and Correctional Services grieve that the scope and implementation of the grievance procedure as outlined in the collective agreement is not being followed. Namely timelines are not being carried out in a fair and equitable manner with many grievances being delayed and stalled for non-specific or unfounded reasons or cause. Such delays are placing grievors under unfair duress and undue stress as well as causing unfavourable working conditions that in some cases are later deemed to be unsafe to the workers. The process that should be followed as per the collective agreement is as follows:
 22.2.1 It is the mutual desire of the parties that complaints of employees be adjusted as quickly as possible and it is understood that if an employee has a complaint, the employee shall meet, where practical, and discuss it with the employee’s immediate supervisor within thirty (30) days after the circumstances giving rise to the complaint have occurred or have come or ought reasonably to have come to the attention of the employee in order to give the immediate supervisor an opportunity of adjusting the complaint.
22.2.2 If any complaint or difference is not satisfactorily settled by the supervisor within seven (7) days of the discussion and/or meeting, it may be processed within an additional ten (10) days in the following manner:
STAGE TWO
22.3.1 If the complaint or difference is not resolved under Stage One, the employee may file a grievance, in writing, through the Union, with their immediate supervisor who will in turn forward the grievance to the senior human resources representative for the ministry or his or her designee.
22.3.2 The senior human resources representative or his or her designee shall hold a meeting with the employee within fifteen (15) days of the receipt of the grievance and shall give the grievor his or her decision in writing within seven (7) days of the meeting with a copy to the Union steward.
22.4 If the grievor is not satisfied with the decision of the senior human resources representative or his or her designee or if he or she does not receive the decision within the specified time, the grievor may apply, through the Union, to the Grievance Settlement
Board (GSB) for a hearing of the grievance within fifteen (15) days of the date he or she received the decision or within fifteen
(15) days of the specified time limit for receiving the decision.
22.5 The employee, at his or her option, may be accompanied and represented by a Union representative at Stage Two of the grievance procedure.
22.6.1 An employee who is a grievor or complainant and who makes application, through the Union, for a hearing before the
GSB or the Ontario Labour Relations Board (OLRB) shall be allowed leave of absence with no loss of pay and with no loss of credits, if required to be in attendance by the Board or Tribunal. Article 22.6.1 shall also apply to pre-hearings, mediation/arbitration or mediation under auspices of the GSB or OLRB.
22.6.2 An employee who has a grievance and is required to attend meetings at Stage One and Two of the grievance procedure shall be given time off with no loss of pay and with no loss of credits to attend such meetings.
22.6.3 Article 22.6.2 shall also apply to the Union Steward who is authorized to represent the grievor at Stage Two of the grievance procedure.
 22.6.4 The Union shall advise the senior human resources representative for the affected ministries with copies to the Director, Centre for Employee Relations of the Union Stewards together with the areas they are authorized to represent, which list shall be updated at least every six (6) months. The ministry will advise the Union corporately when the senior human resources representative for the ministry changes.

Settlement desired: That the current grievance process be reviewed with the goal of establishing a fair and equitable means of establishing reasonable time lines for dealing with employee grievances. Further that current grievance matters be dealt with in an expedited way without further delay in order to prevent further harm to said grievors. All grievances that have been unfairly delayed be assessed for monetary compensation to paid to the grievors and which will be awarded upon the completion of said grievances being heard.

Over and over I hear and also experience facebook blocking care2 members from connecting.  We DO know each other Facebook.  For example I want to connect with my X boyfriend from my high school years and facebook claimed I didn't know him!  If you have been blocked share your story here and sign this petition.  I sent faceblock feedback but was ignored.

I am a big girl Faceblock and to be honest you don't know who I know, my Xs and it's none of your business.  Unblock the blocks Faceblock and allow care2 members to connect!  There is an open thread about this Issue at care2 friends and it's happening to a lot of people.  The fact that Facebook IGNORES feedback sent to them is also inexcusable.

Reject a rate increase

This petition is aimed to stop a rate increase that KCP&L company is requesting from Missouri Regulators.  They received approval for a rate increase of $35,000,000 last year, and now they want more.  They're asking for a rate increase of 15% which will raise rates on average $180/yr.
We have had a mild winter and are not using as much energy as they had hoped for which now puts their projected profits down from $210million to a meager $171million.
They site the rate increase request as a result of poor energy sales and due to the increase in alternative energy usage.  
Raising the rates because Americans are fighting harder for a more green solution is not the answer.

I have a 2010 Nissan Frontier XE. It has 70k miles on it. The warranty is 60k. NISSAN refuses to cover my head gasket on warranty because I am over on miles and because I have my service and repairs done elsewhere in the passed. This is unacceptable. I also have had the water pump and the fan clutch replaced. This truck is a problem child. Nissan knows this but they refuse to do the right thing. Join with me.... BOYCOTT NISSAN. Send a message that 2 years is too short for a lifespan of a truck!

Sometimes it seems like banks can't WAIT to put people out of their homes, leaving a carnage of abandoned houses that pull down values all over the remaining neighborhood. And some of those banks have been caught red handed doing things like filing irregular paperwork to speed up the process of foreclosure even as owners struggle to modify their loans.

California Attorney General Kamala Harris says it has to stop. She is lobbying for a homeowner bill of rights that will curtail predatory lending and precipitous foreclosures.

Kamala described California families and communities as "devastated by the foreclosure crisis," according to a recent Huffington Post article. "We must ensure the deceptive practices that caused it will never happen again," she added.

Tell California legislators to sign the homeowner bill of rights into law.

Autoriza siembras de maíz transgénico para atender intereses económicos sin conocer siquiera los dictámenes técnicos en contra, admite el titular de SagarpaBoletín de prensa - enero 20, 2012En materia de transgénicos “no somos químicamente puros, tenemos intereses económicos y políticos”: Mayorga.

Francisco Mayorga titular de la Secretaría de Agricultura, Ganadería, Desarrollo Rural, Pesca y Alimentación (Sagarpa), admitió que la introducción de maíz transgénico representa un riesgo, no obstante, dijo, en materia de transgénicos “no somos químicamente puros, tenemos intereses económicos y políticos”.

En reunión con el secretario de agricultura Francisco Mayorga, en la que estuvieron presentes investigadores de la Unión de Científicos Comprometidos con la Sociedad (UCCS) y observadores de la Comisión Nacional para el Conocimiento y Uso de la Biodiversidad (UCCS), productores, apicultores, productores de orgánicos y  ambientalistas, le demandaron los argumentos que respaldan las autorizaciones otorgadas para las siembras piloto de maíz transgénico en México. El responsable de la política agrícola del país reconoció que no cuenta con la información de los dictámenes técnicos del Instituto Nacional de Ecología (Ine), de la Comisión Nacional de Áreas Naturales Protegidas (Conanp) y de la Comisión Nacional para el Conocimiento y Uso de la Biodiversidad (Conabio), información que debe ser consultada obligatoriamente, como lo indica la Ley de Bioseguridad de Organismos Genéticamente Modificados (LBOGM), antes de otorgar cualquier permiso de siembra de transgénicos.

“Desconozco los detalles de los dictámenes técnicos, pero contamos con otros asesores científicos, entre quienes está el Dr. Ariel Álvarez (Secretario de la Comisión Intersecretarial para la Bioseguridad de los Organismos Genéticamente Modificados-Cibiogem) con cuya asesoría técnica tomamos las decisiones de aprobar las siembras Piloto” afirmó Mayorga.

“Más allá de ser preocupante es violatorio de la Ley, no tomar en cuenta las opiniones de INE, Conabio y Conanp, instancias que en casi la totalidad de las solicitudes de siembra de maíz transgénico han dado un dictamen negativo, argumentando el riesgo de contaminación de cultivos transgénicos a cultivos nativos”, denunciaron las organizaciones.

“Además sus respuestas ponen en evidencia que las autorizaciones de siembras piloto y experimentales han sido otorgadas en obediencia a presiones que dejan sin efecto los argumentos técnicos y científicos de expertos en aras de los intereses económicos de las empresas Monsanto, Syngenta, Dow AgroScience y Pioneer”, afirmaron las organizaciones.

El funcionario intentó justificar sus decisiones afirmando que no existe una disyuntiva entre preservar la diversidad de maíces mexicanos y permitir la siembra de transgénicos y afirmó que tanto él como el presidente Felipe Calderón “tienen la convicción de que es posible la coexistencia entre el maíz transgénico y los maíces convencionales y criollos” por lo que pretende “ordenar todo esto y escuchar los diversos intereses aunque sean contradictorios”.

Ante la pregunta de Elena Álvarez-Buylla, quien asistió en representación del Programa de Agricultura y Alimentación de la UCCCS, sobre cómo va a garantizar la protección de los maíces nativos de la contaminación por flujo génico de los maíces transgénicos, el Secretario respondió: “ninguna tecnología implica riesgo cero, y los transgénicos no son la excepción. Aceptamos que habrá cierto riesgo de contaminación con transgenes de las variedades transgénicas a las variedades nativas, pero este riesgo se tratará de minimizar ya que sólo se sembrará maíz amarillo y no blanco como el producido por las variedades nativas, se sembrará en ciclos distintos y bajo agricultura por contrato”.

La especialista  le explicó que con base en los datos sobre diversidad de variedades nativas y especies silvestres emparentadas al maíz (Tripascum y Teozintle), publicados por Comisión Nacional para el Conocimiento y Uso de la Biodiversidad (Conabio), por encargo del mismo Gobierno Federal, se espera que en algunas de las zonas no estudiadas o poco colectadas aún haya más diversidad, la cual está en riesgo debido a la movilidad de transgenes de maíz vía polen y semillas a miles de kilómetros de distancia de la fuente. “Ha quedado demostrado, sin dejar lugar a dudas, que NO es posible la coexistencia de maíces transgénicos y nativos”.

También se le aclaró al secretario que el maíz amarillo pertenece a la misma especie - Zea mays- que el maíz blanco, y son interfértiles. Por lo tanto, los transgenes del maíz amarillo transgénico se podrán ir contaminando el maíz blanco nativo. Los datos científicos demuestran que el flujo génico vía intercambio de semillas trasciende las estaciones y años, de tal suerte que el desfasar las siembras -que además no será posible en la práctica pues CONABIO ha demostrado traslape en las zonas de maíz híbrido con riego y maíces nativos, y los ciclos de ambos son variables según las lluvias- como aclaró el Dr. Alejandro Espinosa, también de la UCCS y experto en maíz, no será efectivo para impedir la contaminación. Finalmente se asentó que por ahora el gobierno no ha demostrado la capacidad de monitoreo en tanto no ha publicado datos de contaminación, y los datos de contaminación publicados por la ciencia formal.

Otro riesgo que el responsable de velar por los intereses de los agricultores desconoce, según sus propias afirmaciones, es la amenaza que se cierne sobre los pequeños productores cuyos cultivos sean contaminados con transgénicos y las posibilidades de denuncias penales que ha expresado SENASICA ya que dijo desconocer la Ley de Propiedad Intelectual (LPI). Pareciera que tampoco conoce la Constitución pues no pudo responder a las preguntas sobre las evidentes prácticas monopólicas desarrolladas por Monsanto.

Cuando los apicultores señalaron la resolución del Tribunal de Justicia Europeo (TJE) sobre el impedimento establecido para comprar miel con trazas de transgénicos, el Secretario demostrando la grave irresponsabilidad con la cual se están otorgando permisos, dijo: nos sorprendió esta situación en el mercado europeo. Enseguida comentó que se está negociando sanciones menos duras para hacer laxas las medidas de  protección al consumidor europeo. 

Las organizaciones Asociación Nacional de Empresas Comercializadoras de Productores del Campo (Anec), el Frente Democrático de Chihuahua (FDC),  la Organización Nacional de Apicultores,  la Sociedad mexicana de Certificación Orgánica,  Alternativas y Procesos de Participación Social A.C., el Grupo de Estudios Ambientales, Semillas de Vida y Greenpeace recalcaron que con esta reunión el titular de Sagarpa sólo logró evidenciar la falta de argumentos legales, técnicos, científicos y económicos que respalden su decisión de autorizar la experimentación a campo abierto de maíz transgénico, que desdeña los argumentos científicos y mostró la falta de interés en el cumplimiento de la Ley: “Aunque todas las leyes prohibieran los transgénicos no se garantizará que no se siembren”, afirmó el secretario.

If the David Gordon Love (EUPA Training Council) online defamation
saga wasn't the huge item in Western Australian politics this week,
then what was? As we all know, David Love is the bloke who made an
(albeit unsuccessful) tilt with TAC auditor Helen McCarter in the
business world in the early 2000's. Add to that Joe Fiala of CEPU
trying to make inroads from the union, to affecting our VET education
system. Talk about a power grab attempt, Mr. Fiala! But this is just
the start of Mr. Love's troubles, who has for the past several years
tried to defraud the Australian Taxation Office.

It all started with a posting made by Kyle Kutasi (NECA) on Usenet.
Mr. Kutasi, who holds a degree in law/commerce from Sydney University
and had a tilt at University politics there, is of course the bloke
who is described as a "racist, sexist, homophobic nerd" by
Anarchobase, and (successfully) filed in a defamation proceeding as a
former Liberal Party member against Melbourne University Press for
calling him a "bestial character, a criminal, thug and standover man"
in the NSW District Court. He was described as "a hooter, a hollerer,
a drinker (who) seemed to live at the local pub (where there was) a
legitimate suspicion ... that he started most of the fights". Kutasi
is also described by Janine Cohen as "abusive and intimidating to
fellow Liberals". Kyle has gone so far as to get a statutory
declaration about a journalist saying "I know more about you than you
could possible know. I have files on you. I have photos of you. I have
statements from women saying that you assaulted them". Kutasi rooted
David Clarke's daughter Ann-Marie Clarke. Kutasi was named on Vex News
as a "pathological liar". Kutasi is a man of anger, stating on Vex
News, "Don't know where you get your info buddy, but its a pretty
shithouse source!" This is what Japanese sounding Mr. Kutasi wrote:

of Western Australia on January 3, 2012. Doesn't exactly paint Mr.
David Love in the brightest light:
: 1 Mr. Love stated on Dec/2 he wouldn't receive/pay for $14,896
services left on 0.5yr research contract (Aug/22-Feb/24), since:

: 1.1 "Casual employment" allowed for cessation whenever: Mr. Love
failed to comply with ATO requirements for "casual employee"
treatment, hence this point was rescinded.

: 1.2 There'd been insufficient quality of work: Quality of work
similarly rescinded based on reference amount, length of document,
originality of information, appraisals from other TC's.

: 2 In a surprise jab, reasons in conciliation were altered to
"unethical, if not illegal" conduct, later explained to be use of
proprietary university databases to conduct private work.

: 2.1 WAIRC fees (29.6km * 2 @ $0.63 / km (ATO)=$37.30, and $50
application fee = $87.30) asked for in addition due to lack of want to
conciliate in good faith, and "put all cards on table". Respondent
claimed this was apart of his "legal strategy".

: 2.2 Advised Respondent contemporaneously in conciliation
"proprietary database" used datasets created by self; and no resources
were used of the University's to conduct work.

: 2.3 Mr. Love is aware of Uni contacts because he asked to apply for
an Australian Research Council grant. Mr. Love discarded the grant
application before any serious work was actually done.

: 2.4 Although Mr. Love knew university resource not used to conduct
work, when faced with difficulty finding data in public admin, Mr.
Love requested their "database" use, because "that's what I want - I
don't care how you get it - just get it".

Mr. Love is being sued for $15,242.40 in total. I smell bankruptcy
here?

I contacted the WAIRC (raised in 2.1) for more information, and they
directed me to case No. U 199 of 2011:

: I (Jeremy) worked for the EUPA Training Council (which primarily
reports to the Department of Training and Workforce Development DTWD,
and is of ABN 76 710 050 832 ELECTRICAL UTILITIES AND PUBLIC
ADMINISTRATION TRAINING COUNCIL INC) as a researcher, beginning Monday
22 August 2011, intended until Friday 24 February 2012, pending a one
month probationary period remunerated at $35/hr, paid fortnightly,
with the employment offer delineated it "equates approximately $69,000
per annum". On successful completion, this hourly rate was boosted to
$40/hr. This employment ceased after being dismissed at approximately
9:20am on Friday December 2 2011.

: Dismissal was on the grounds, as delineated on Friday December 2:

: - Work done was "unusable" and that the Managing Director had paid
the "best part of twenty thousand dollars" for "nothing": In response,
I (Jeremy) suggested that non-delivery was not possible, because
checks were made in the first week essentially every second day; and
subsequently, every week, along with fortnight submissions. If the MD
was disappointed with the result, that the onus was on him to ensure
the requisite quality was met, and instruction given earlier to
remedy.

: - That "when requested a wall to be painted in green, received a red
wall instead", in particular, development of such tools as the web
site, in lieu: In response, I (Jeremy) delineated, and came to
agreement with the MD, that the e-scan had been "completed" for the
electrotechnology, electricity supply, gas supply, waste, water, and
local government - and that the shortfall, was only for corrective
services, public safety, and public sector - of which I was asked by
the MD specifically to spend 1 day on, and hence the quality of those
sections reflected the singular day effort. On the following Monday 28
November, I approached the MD to obtain a clarification given the
inconsistency from the completion of the various e-scans and the
"you've given me nothing", with the MD stating that on Thursday, he
intentionally delayed a while before speaking to me, because he
understood he was "angry", and that with several points, he had
"retreated" - with the exception of the three e-scans (below).

: - That even the three documents produced over my (Jeremy's) weekend
"wasn't what I [David] wanted": Although my (Jeremy) copy was asked to
be deleted by the MD, we desire to obtain discovery of these
documents, which would tend to show that the quality of the work, met,
if not exceeded that, of work over the weekend (which is unpaid for,
and further to the required work) - with appropriate referencing,
gathering of secondary data facts, and prima facie analysis.

: - Publishing changes on the web site without prior approval: I
(Jeremy) have obtained permission, asked, but on numerous occasions,
the MD has forgotten that approval was given (or it was given without
him knowing what the consequence was). Commonly, prior discussions
later raised with the MD, would be responded in "no, I don't remember
- could you refresh my memory?", which goes to propensity to recount
facts correctly. In any circumstance, this is just a minor
misunderstanding, and doesn't warrant the termination of contract.

: - That the terms of "casual employment" are such that, the Managing
Director, can, at his own discretion, terminate the employment at his
own will: My response to him was that I had felt "exploited" as a
result of not knowing what "casual employment" constituted. However,
the terms of employment were delineated as between a fixed period
(Monday 22 August 2011 - Friday 24 February 2012, for 26 working
weeks), with the "maximum 38 hour working week" delineated by the MD
as meaning "that's all I [David] can pay you; you can work more, but
that's up to you". Furthermore, if the employment agreement was such
that the termination could occur at any time, the "probationary
period" thus becomes moot, and could constitute a misleading and
deceptive clause of agreement (and its presence suggests that
termination can only be made during the probationary period). It is
also notable, following the probationary period, remuneration was
bumped up from $35/hr (+9%) to $40/hr.

: - That the "contractual" arrangement had no veracity, as a result of
the fact that it wasn't written: This is a question of law that is
disputed, as being wrong.

: Prior, on Thursday November 24, the Managing Director requested my
pay check to not be put through on Wednesday November 23, which was
reinstated on Friday November 25. On Thursday November 24, the MD
brought up:

: - Utilizing organizational time to do other organization's work: The
response provided was that this was based on hearsay evidence from a
colleague, and that direct evidence would tend to directly contradict
this (namely, that an employee, if desiring to work on another
organization's work, wouldn't tend to turn the direction of the
computer screen, as to be directly in view of a person who walked into
the room). It is believed, given the MD hadn't raised prior issues
with me, and that the first time he did was on Thursday November 24,
that this fact lies, within his interpretation, as the pinnacle issue;
given that I'd departed the organization at Wednesday November 23 at
4.30pm, and that only Kevin (my colleague) and the MD discussing were
the only between events.

: - That he had an issue with the level of noise: After conferring
with Kevin (colleague), it was decided that this was likely due to a
single conversation (in particular), several weeks ago, which was
directly work related, although "didn't seem to be going anywhere". On
Monday, 28 November, Kevin brought up that he had been disappointed
about the lower levels of conference, and that he had hoped the
workplace could still involve chitter chatter to "make the workplace
fun".

: - That the work could not be understood by stakeholders, as it
contained jargonacious and loquacious language: Of which I (Jeremy)
responded that I would work on between Tuesday November 29, and
intended on submitting on Friday December 2. This was never even read.

: I (Jeremy) also brought up, in response, contemporaneously in
response to being dismissed, on Friday December 2:

: - That I (Jeremy) felt there had been a history with the employer
(David Love), given that the person I was replacing (Lee Pritchard),
also underwent a "forced resignation" (as delineated by Kevin),
suggesting that the employer think about reaching an amicable solution
rather than resolving to the courts.

: I (Jeremy) am seeking for compensation of and/or reinstatement of
employment for the remaining months. The pay check is up to date until
November 23. Including the Christmas exclusion of December 23-January
3, is $3,040 due December 7, $3,040 due December 21, $912 due January
4 (pro rata for 3 days, December 22, January 3 and 4), $3,040 due
January 18, $3,040 due February 1, $3,040 due February 15, and $608
due February 17 (pro rata for 2 days). This amounts to $16,720.

: The payable amount from Fri 25/11 to the end of contract is
$14,896.1 The defendant (Mr. David Love) contests that as a result of
the word "casual", the contractual arrangement can be broken at any
time. The plaintiff argues that the arrangement was contractual, and
there is thus breach of contract. Even if it is construed there is
casual employment, it is argued that simply delineating the words
"casual" doesn't mean a worker doesn't have the right to expectation
of continued employment, where delineated, and can be demonstrated by
constructive facts.

: The WAIRC filing undertakes the defendant's (David) assumption
employment was casual (as stated on Fri 2/12). The right is reserved
to dispute this classification. The plaintiff is willing to accept
this point uncontested, such that the WAIRC is directed employment was
contractual, and thus ultra vires to its jurisdiction. The matter can
then be contested in Court for contractual breach. Where contest is
made employment was casual, WAIRC costs will be requested.

repayments, TFN not filed with ATO, only 4 invoices issued over
contracting period - all showing intention to contract.

So President Obama has proposed the "Buffett Rule," which would require the wealthiest Americans to pay a tax rate at least as high as the middle class. Republicans are already calling this "class warfare," and they will fight this plan with everything they have.

Fairness for AMS Security Workers

Security workers at the UBC Alma Mater Society are fighting for a fair contract. Currently, the AMS pays its security staff significantly less than its administrative staff, who also receive greater benefits. The Canadian Office and Professional Employees Union Local 378, which represents both groups, is calling on the AMS to recognize that it's unfair to pay its hard-working security staff - many of whom are working themselves through school or supporting families - less than its other employees.

Tell the UBC AMS that it's time to end the systemic wage discrimination against the people who devote their time and energy to making AMS property safer for students and faculty.

Paying for a service or repair and primary issue is still not resolved

Are you fed up with paying for a repair or service just to find out you have to 
pay more money than orginally estimated. Example; I scheduled my car to be serviced, only to find numerous parts were replaced and my problem still exist. How come dealerships can not fix the problem without a lot of trail and error at
the owners expense. They act as if this is the first time the repair had to be
made. How about a phone call to let us know the cost of the repair or service.

Clive Reynoldson faces legal action over UNACCREDITED COURSE delivered at ECU

Since Kerry Owen Cox has taken over as VC - the reputation of ECU has gone down hill.

Clive Reynoldson is a classical example of a psychopath. A person who is seemingly normal in day-to-day life, trying to seem humble (wearing an expensive cotton pullover, rather than a business suit) and interest in teaching (includes only links to e-learning pedagogy on his page). However, when it comes to hard decisions like helping failing students, is hopeless. There, he demonstrates psychotic behaviours, unwanting to help failing students. It is these sorts of people we need to rid from our public universities. It is these people our public taxpayer dollars are being wasted upon.

Kerry Cox said "high school leavers with an overall average of 42% in all subjects would be able to gain admission", and "Audrey Jackson of the Association of Independent Schools argues students may be risking rejection by employers after graduating from ECU, due to a perception its standards were not being maintained". Prof Kerry Cox is one controversial bastard. This guy has got into more trouble than the early settlers in Australia. You've got to love how Kerry Cox is putting out media releases to spin his "Google listing", but every independent news source have comments such as:

- "graduates... could take legal action... because the program failed to be accredited", with Mr Cox saying he was "unaware of any legal action". You've got to love how this dispicable liar says students were "made aware" of the non-accredited status of the physiotherapy course - dude, that was AFTER this "fiasco" - not when we signed up for it, dude! - "13,000 ECU students have been caught up in a blunder... Kerry Cox said incorrect information about the status of some students was provided to Transperth". But the problem Mr Cox? A Public Transport Authority spokeswoman said ONLY ecu had experienced the "system failure" and students from other unis were unaffected. This caused "13,000 students to become temporarily unenrolled" - WTF?? - MDIS (Singaporean top private education provider) has filed legal suit in the High Court of Singapore (S158/2011/B) against ECU's Kerry Cox... on 9 March 2011... for breach... damages... several defamatory remarks... by sending emails... to students... to hurt the strong reputation of MDIS. - School leavers will get places at ECU after studying... Year 10 courses. This has got to be the most ridiculous. UWA, Curtin and Murdoch all say it's ridiculous, with Murdoch's Gary Martin saying it "do[es] not provide adequate evidence of a prospective student's capacity", Curtin's Lance Twomey saying "you are going to set a certain number of kids up for failure even before they start", even the Curriculum Council's CEO David Wood saying "it will be a pity". If the David Gordon Love (EUPA Training Council) online defamation saga wasn't the huge item in Western Australian politics this week, then what was? As we all know, David Love is the bloke who made an (albeit unsuccessful) tilt with TAC auditor Helen McCarter in the business world in the early 2000's. Add to that Joe Fiala of CEPU trying to make inroads from the union, to affecting our VET education system. Talk about a power grab attempt, Mr. Fiala! But this is just the start of Mr. Love's troubles, who has for the past several years tried to defraud the Australian Taxation Office.

It all started with a posting made by Kyle Kutasi (NECA) on Usenet. Mr. Kutasi, who holds a degree in law/commerce from Sydney University and had a tilt at University politics there, is of course the bloke who is described as a "racist, sexist, homophobic nerd" by Anarchobase, and (successfully) filed in a defamation proceeding as a former Liberal Party member against Melbourne University Press for calling him a "bestial character, a criminal, thug and standover man" in the NSW District Court. He was described as "a hooter, a hollerer, a drinker (who) seemed to live at the local pub (where there was) a legitimate suspicion ... that he started most of the fights". Kutasi is also described by Janine Cohen as "abusive and intimidating to fellow Liberals". Kyle has gone so far as to get a statutory declaration about a journalist saying "I know more about you than you could possible know. I have files on you. I have photos of you. I have statements from women saying that you assaulted them". Kutasi rooted David Clarke's daughter Ann-Marie Clarke. Kutasi was named on Vex News as a "pathological liar". Kutasi is a man of anger, stating on Vex News, "Don't know where you get your info buddy, but its a pretty shithouse source!" This is what Japanese sounding Mr. Kutasi wrote:

: 1 Mr. Love stated on Dec/2 he wouldn't receive/pay for $14,896 services left on 0.5yr research contract (Aug/22-Feb/24), since:

: 1.1 "Casual employment" allowed for cessation whenever: Mr. Love failed to comply with ATO requirements for "casual employee" treatment, hence this point was rescinded.

: 1.2 There'd been insufficient quality of work: Quality of work similarly rescinded based on reference amount, length of document, originality of information, appraisals from other TC's.

: 2 In a surprise jab, reasons in conciliation were altered to "unethical, if not illegal" conduct, later explained to be use of proprietary university databases to conduct private work.

: 2.1 WAIRC fees (29.6km * 2 @ $0.63 / km (ATO)=$37.30, and $50 application fee = $87.30) asked for in addition due to lack of want to conciliate in good faith, and "put all cards on table". Respondent claimed this was apart of his "legal strategy".

: 2.2 Advised Respondent contemporaneously in conciliation "proprietary database" used datasets created by self; and no resources were used of the University's to conduct work.

: 2.3 Mr. Love is aware of Uni contacts because he asked to apply for an Australian Research Council grant. Mr. Love discarded the grant application before any serious work was actually done.

: 2.4 Although Mr. Love knew university resource not used to conduct work, when faced with difficulty finding data in public admin, Mr. Love requested their "database" use, because "that's what I want - I don't care how you get it - just get it".

Mr. Love is being sued for $15,242.40 in total. I smell bankruptcy here?

I contacted the WAIRC (raised in 2.1) for more information, and they directed me to case No. U 199 of 2011:

: I (Jeremy) worked for the EUPA Training Council (which primarily reports to the Department of Training and Workforce Development DTWD, and is of ABN 76 710 050 832 ELECTRICAL UTILITIES AND PUBLIC ADMINISTRATION TRAINING COUNCIL INC) as a researcher, beginning Monday 22 August 2011, intended until Friday 24 February 2012, pending a one month probationary period remunerated at $35/hr, paid fortnightly, with the employment offer delineated it "equates approximately $69,000 per annum". On successful completion, this hourly rate was boosted to $40/hr. This employment ceased after being dismissed at approximately 9:20am on Friday December 2 2011.

: Dismissal was on the grounds, as delineated on Friday December 2:

: - Work done was "unusable" and that the Managing Director had paid the "best part of twenty thousand dollars" for "nothing": In response, I (Jeremy) suggested that non-delivery was not possible, because checks were made in the first week essentially every second day; and subsequently, every week, along with fortnight submissions. If the MD was disappointed with the result, that the onus was on him to ensure the requisite quality was met, and instruction given earlier to remedy.

: - That "when requested a wall to be painted in green, received a red wall instead", in particular, development of such tools as the web site, in lieu: In response, I (Jeremy) delineated, and came to agreement with the MD, that the e-scan had been "completed" for the electrotechnology, electricity supply, gas supply, waste, water, and local government - and that the shortfall, was only for corrective services, public safety, and public sector - of which I was asked by the MD specifically to spend 1 day on, and hence the quality of those sections reflected the singular day effort. On the following Monday 28 November, I approached the MD to obtain a clarification given the inconsistency from the completion of the various e-scans and the "you've given me nothing", with the MD stating that on Thursday, he intentionally delayed a while before speaking to me, because he understood he was "angry", and that with several points, he had "retreated" - with the exception of the three e-scans (below).

: - That even the three documents produced over my (Jeremy's) weekend "wasn't what I [David] wanted": Although my (Jeremy) copy was asked to be deleted by the MD, we desire to obtain discovery of these documents, which would tend to show that the quality of the work, met, if not exceeded that, of work over the weekend (which is unpaid for, and further to the required work) - with appropriate referencing, gathering of secondary data facts, and prima facie analysis.

: - Publishing changes on the web site without prior approval: I (Jeremy) have obtained permission, asked, but on numerous occasions, the MD has forgotten that approval was given (or it was given without him knowing what the consequence was). Commonly, prior discussions later raised with the MD, would be responded in "no, I don't remember - could you refresh my memory?", which goes to propensity to recount facts correctly. In any circumstance, this is just a minor misunderstanding, and doesn't warrant the termination of contract.

: - That the terms of "casual employment" are such that, the Managing Director, can, at his own discretion, terminate the employment at his own will: My response to him was that I had felt "exploited" as a result of not knowing what "casual employment" constituted. However, the terms of employment were delineated as between a fixed period (Monday 22 August 2011 - Friday 24 February 2012, for 26 working weeks), with the "maximum 38 hour working week" delineated by the MD as meaning "that's all I [David] can pay you; you can work more, but that's up to you". Furthermore, if the employment agreement was such that the termination could occur at any time, the "probationary period" thus becomes moot, and could constitute a misleading and deceptive clause of agreement (and its presence suggests that termination can only be made during the probationary period). It is also notable, following the probationary period, remuneration was bumped up from $35/hr (+9%) to $40/hr.

: - That the "contractual" arrangement had no veracity, as a result of the fact that it wasn't written: This is a question of law that is disputed, as being wrong.

: Prior, on Thursday November 24, the Managing Director requested my pay check to not be put through on Wednesday November 23, which was reinstated on Friday November 25. On Thursday November 24, the MD brought up:

: - Utilizing organizational time to do other organization's work: The response provided was that this was based on hearsay evidence from a colleague, and that direct evidence would tend to directly contradict this (namely, that an employee, if desiring to work on another organization's work, wouldn't tend to turn the direction of the computer screen, as to be directly in view of a person who walked into the room). It is believed, given the MD hadn't raised prior issues with me, and that the first time he did was on Thursday November 24, that this fact lies, within his interpretation, as the pinnacle issue; given that I'd departed the organization at Wednesday November 23 at 4.30pm, and that only Kevin (my colleague) and the MD discussing were the only between events.

: - That he had an issue with the level of noise: After conferring with Kevin (colleague), it was decided that this was likely due to a single conversation (in particular), several weeks ago, which was directly work related, although "didn't seem to be going anywhere". On Monday, 28 November, Kevin brought up that he had been disappointed about the lower levels of conference, and that he had hoped the workplace could still involve chitter chatter to "make the workplace fun".

: - That the work could not be understood by stakeholders, as it contained jargonacious and loquacious language: Of which I (Jeremy) responded that I would work on between Tuesday November 29, and intended on submitting on Friday December 2. This was never even read.

: I (Jeremy) also brought up, in response, contemporaneously in response to being dismissed, on Friday December 2:

: - That I (Jeremy) felt there had been a history with the employer (David Love), given that the person I was replacing (Lee Pritchard), also underwent a "forced resignation" (as delineated by Kevin), suggesting that the employer think about reaching an amicable solution rather than resolving to the courts.

: I (Jeremy) am seeking for compensation of and/or reinstatement of employment for the remaining months. The pay check is up to date until November 23. Including the Christmas exclusion of December 23-January 3, is $3,040 due December 7, $3,040 due December 21, $912 due January 4 (pro rata for 3 days, December 22, January 3 and 4), $3,040 due January 18, $3,040 due February 1, $3,040 due February 15, and $608 due February 17 (pro rata for 2 days). This amounts to $16,720.

: The payable amount from Fri 25/11 to the end of contract is $14,896.1 The defendant (Mr. David Love) contests that as a result of the word "casual", the contractual arrangement can be broken at any time. The plaintiff argues that the arrangement was contractual, and there is thus breach of contract. Even if it is construed there is casual employment, it is argued that simply delineating the words "casual" doesn't mean a worker doesn't have the right to expectation of continued employment, where delineated, and can be demonstrated by constructive facts.

: The WAIRC filing undertakes the defendant's (David) assumption employment was casual (as stated on Fri 2/12). The right is reserved to dispute this classification. The plaintiff is willing to accept this point uncontested, such that the WAIRC is directed employment was contractual, and thus ultra vires to its jurisdiction. The matter can then be contested in Court for contractual breach. Where contest is made employment was casual, WAIRC costs will be requested.

Behind Dr. Christian Sandor's tokenistic support of TEDx is a SOCIOPATH.

Though relatively normal seeming, he has a hidden life online, that demonstrates his true self is a vindictive, misogynistic, homophobicic, racist, genocidal, megalomaniacal, sadomasochistic, capriciously malevolent bully.

FOI applications from UniSA reveal continued cyber bullying of Jeremy Shum (his victim):

- On February 10 and 11, using his UniSA account, Christian Sandor refreshed his victim's web site more than 23.8k times on Thursday February 10, clicking the advertisements more than 440 times; and then again on Friday February 11, where he refreshed the ads more than 70.7k times, clicking the advertisements more than 2,400 times.

- In March, Christian Sandor also submitted frivolous complaints to the domain authority, attempting to intentionally cause pain for his victim. In April, he launched a DoS attack on his victim's web site where he utilised more than 20gb of bandwidth in a single day

- In June and leading up until mid August, Chris Sandor created a fake e-mail entitled "agentshum@gmail.com" where he e-mailed several national councils (including law councils) in an intentional attempt to embarrass his victim

- In July, Chris Sandor developed a web page on a gay site targeting his victim (http://gaydar.com.au/ProfileView.asp?userid=agentshum) where he somewhat attempts to accurately describe his victim, but makes notable discrepencies, saying the victim is "gay" but not "out" and looking for "slim cock and a cute face", does drugs "socially", and has fetishes, inter alia, in "Body Hair, Diapers, Foreskin, Hands, Jocks, Lycra, Nipples".

- On July 2, Chris Sandor also created a Twitter account (https://twitter.com/#!/agentshum), where he makes statements such as "im untouchable... unless you touch me hehehhee", attempts to anger 4chat by calling them "lame ducks", tries to trend "blows[jobs]" and "bro-love", says his victim "made a sex tape", calls him a "professor", retweets the gaydar website with "gayday", and promotes a Pulteney 431 Sauna "premier gay and bi male bathhouse" which he says his victim "loves it". Interesting also, is how he retweets, Hillsong, as well as a list of pro-homosexual organizations quoting religious folk - as well as a requisite Miley Cyrus quote.

Christian Sandor is evidentally a person who tries to put his victims in as much psychosocial pain as possible, and does it with his twisted I.T. knowledge to avoid Police prosecution. This person belongs in jail, and will be caught eventually.

Another page states there may be criminal repercussions:

- In time, Sandor will be caught and charged with-- dishonestly dealing in documents, improper use of another identity, criminal defamation and publication of misleading material

Though this may seem like a bit farfetched at first, but a Google forum web page (https://groups.google.com/forum/#!search/%22christian$20sandor%22/free.pt/e02B8bNKxe8/o4AZ5BOYw0EJ) says that Christian Sandor (and a friend of his who is accused of working with him to bully the kid, Stewart von Itzstein) was forced to take a half year "leave". Described as a "nazi homophobic dick", evidence was provided against Chris Sandor, as below:

- On the IP address 130.220.71.21 (which belongs to the UniSA IP subnet mask 130.220.71.*), on 16 July 2010 at 02:24, this individual defaced Jeremy Shum's wikipedia page, stating he was a "suspected paedophile!!!" (http://en.wikipedia.org/w/index.php?title=Shum&diff=436559749&oldid=373735360)Later, on the same IP address 130.220.71.21 (http://en.wikipedia.org/wiki/User_talk:130.220.71.21) on 16 July 2010 at 02:26, this individual defaced Jeremy Shum's wikipedia page, stating he was a "convicted paedophile" (http://en.wikipedia.org/w/index.php?title=Shum&diff=436559749&oldid=373735629). The first edit that he was "suspected" means the individual knew that Jeremy Shum is not a convicted paedophile. Therefore, the addition that he was "convicted" should constitute criminal defamation (making a statement knowing it is false).

- Similarly, on the IP address 130.220.71.20 (http://en.wikipedia.org/wiki/User_talk:130.220.71.20) on 10 January 2011 at 01:29, this individual defaced Jeremy Shum's wiki page, blanked it, stating "you are a retard" (http://www.wikihow.com/index.php?title=Be-Inspired-by-Jeremy-Shum&diff=6279639&oldid=5469320)

- Then again, on the IP address 130.220.71.19 (http://en.wikipedia.org/wiki/User_talk:130.220.71.19) on 16 February 2011 at 01:00, this individual defaced Jeremy Shum's wiki page, adding to be like him, you must have a 10" Black Rubber Dong. (http://www.wikihow.com/index.php?title=Be-Inspired-by-Jeremy-Shum&diff=6279639&oldid=5625386) Although it is unclear what this reference is to, Amazon describes it as equivalent to a "police baton". Assumingly, this person is describing that Jeremy inserts this huge instrument up his anus for sexual pleasure, as he enjoys "gay sex". They even make the effort to duplicate Jeremy Shum's trademark "It's a magical day!" signature, which is clear evidence they have viewed Jeremy's email, and thus signature.

- Christian Sandor and Stewart von Itzstein have clearly done it in a manner to avoid traceability, taking advantage of their specialist I.T. knowledge. What I find interesting however, is that Chris Sandor and/or Stewart von Itzstein weren't charged by the Police, for stating Jeremy Shum was a "convicted paedophile".

Clearly, these allegations on the TedX YouTube aren't vexatious then.

Chris Sandor's accomplice, Stewart von Itzstein, runs his own business on top of his work at University (http://abr.business.gov.au/SearchByAbn.aspx?abn=33557023501), and doesn't pay GST tax. His full name is described as "Garry Stewart Anthony von Itzstein". He shut his business down in February 26, 2008 to pursue University work; before being (forced by the University?) to restart his business on July 30 2010. He enlists a "5127 SA" address as his business location, but moved addresses on August 6 2010.

It seems Sandor and von Itzstein's tactics are taken right out of the textbook from the National Crime Prevention Council (https://www.google.com/support/youtube/bin/answer.py?answer=126266), involving "pretend they are other people online to trick others", "spread lies and rumors about victims", "post mean comments".

On a related story, the "UniSA spokeswoman" who was identified in an article by Heather Kennett has also been exposed as Michele Nardelli, the Manager of News and Media at the University of South Australia. In her university profile, it says she helps train staff in the media, holds a degree in psychology (though just arts), and was apart of "Circle of Friends" as a member from 2002-2004, a group helping refugees (in obvious attempt to manipulate public opinion about her). This woman is attributed as the "smear lady", with an inner circle of Peter Hoj saying - it was all Michele Nardelli's doing in smearing Jeremy Shum - not Hoj's.

One wonders what the Police's action are next? There are also interesting accusations against a SAPOL officer, Jim Jeffery (who apparently was behind an "Agape pastor smear") for failing to prosecute Christian Sandor, and that there may possibly (allegedly) be corruption occurring there!

They provide a variety of telecommunication services such as digital lines, high speed Internet, Intranet, public telephony, teleauditor, worldwide long distance calling, and zero plus calling at credit card only payphone stations Germany and other countries. BBG Global's website owns and operates 350,000 pay phones in airports, train stations, and hotels in more than 30 countries. Reports are that the cost of using BBG Communications has been a problem for quite some time. Now, US troops have decided to fight back. Americans must join in and demand justice for all who have been affected; we can do this.

When Specialist Reynald Matias was heading to Afghanistan with his Army unit late last year,their chartered flight stopped to refuel at Leipzig-halle Airport in Germany.During a brief layover, he called his wife in Tacoma, Wash.,using his debit card on a pay phone in the terminal's troops-only transit lounge. His wife, Crystal, asked, "What are they charging you?" He did not know, so she told him to hang up. A few days later she got the answer: $51 for what she estimated was a 2minute call. "Military pay isn't up there, "she said. "It really hurt us." Another Soldier, Sgt.Corder, said he was billed $41 last year for a 3-second call in which he left a message on the family's answering machine. It is time for BBG Communications & BBG Global to stop taking advantage American Soldiers who are already under such stress fighting in defense of the U.S. Now, their families are subjected to financial distress; this is completely unacceptable.
